Please carefully review these terms and conditions (“Terms”) prior to submitting your Public Incident Report. By accessing or using the StandWithUs Saidoff Law website at www.standwithus.com/law (the “Website”), you acknowledge that you have read, understood and accept these Terms.

Terms and Conditions

​These Terms have been prepared by StandWithUs Saidoff Law, a division of Israel Emergency Alliance dba StandWithUs (“StandWithUs”), a 501(c)(3) nonprofit organization, in conjunction with the online Public Incident Report filed directly on our Website, and are for informational purposes only. Nothing in these Terms or on the Website shall be deemed to constitute legal advice, and any information submitted by you through the Website is done so voluntarily, for informational purposes only. Neither your submission of any information through the Website nor receipt of such information by StandWithUs Saidoff Law creates an attorney-client relationship.  StandWithUs Saidoff Law will review any information submitted to it through the Website and evaluate whether further action by StandWithUs and/or StandWithUs Saidoff Law is appropriate. This may include gathering facts and data, contacting witnesses, and providing educational legal resources. By taking any such actions, however, StandWithUs Saidoff Law is not agreeing to act as your legal representative and/or asserting claims for monetary damages or restitution on your behalf. Any such legal representation, if appropriate, will be addressed and initiated through a separate Engagement Agreement.

StandWithUs Saidoff Law cannot make promises or guarantees as to the outcome of your situation. You may not assume that communication with attorneys from StandWithUs Saidoff Law based on any information shared through the Website will be protected by any attorney-client or other legal privilege. Any e-mail or other communication sent from you to us through the Website will not be treated as confidential unless StandWithUs Saidoff Law agrees in advance to treat it as such. Accordingly, please be mindful about sending any information about any matter which may involve you unless and until we have formalized a written Engagement Agreement. We will keep your name, address, telephone number, and email confidential unless you give us express written permission to use such information or unless we are ordered to turn it over by a court of law or government agency.

Any expression from StandWithUs Saidoff Law regarding the strength of your claim is a matter of opinion only. If the situation warrants, and with your permission, and only upon executing a separate written Engagement Agreement (not included with these Terms), StandWithUs Saidoff Law may assert a claim on your behalf. Upon obtaining such permission, StandWithUs Saidoff Law may also contact partner organizations or pro bono attorneys on your behalf to elicit their legal advice and/or their direct representation on your matter.

Waiver

I have read and acknowledge the foregoing Terms, and I further acknowledge that the activities of StandWithUs and StandWithUs Saidoff Law, and StandWithUs’ past and present members, officers, directors, agents, employees, representatives, and related entities thereof, are advisory only, and that neither StandWithUs nor any of its employees has agreed to act as my legal counsel regarding my situation. I further understand that no attorney-client relationship currently exists with StandWithUs or StandWithUs Saidoff Law, and that transmission of any information on and through the Website is not intended to create, and receipt by StandWithUs and/or StandWithUs Saidoff Law does not constitute, an attorney-client relationship or give rise to any attorney-client privileges. It is my further understanding that, regardless of the activities of StandWithUs, a statute of limitations may exist requiring that I initiate legal action for my situation by a specified date to preserve my legal rights, and that acknowledgment of these Terms, submission of the Public Incident Report on the Website, any information on the Website, and/or any actions by StandWithUs without a separate fully executed written Engagement Agreement do not constitute such legal action.

I understand that it is solely my responsibility to ensure that legal action is initiated prior to the expiration of any applicable statute of limitations regardless of whether or not StandWithUs Saidoff Law agrees to represent me.

I further agree that unless the parties fully execute a separate written Engagement Agreement, under no circumstances shall StandWithUs be responsible for any liability, loss, or damage which I may suffer, caused by StandWithUs, or any third party, resulting from StandWithUs involvement regarding my situation. By my signature below, I and my successors, transferees, assigns and related entities, hereby release StandWithUs and its predecessors, successors, and affiliated entities, and current and former board members, shareholders, directors, officers, employees, agents, volunteers, representatives and assigns from any and all claims, demands, causes of action, actions, rights, liabilities, contract obligations, damages, attorney’s fees, costs, torts, suits, debts, sums of money, accountings, reckonings, bills, covenants, controversies, agreements, promises, at law or in equity or otherwise, whether direct or indirect, known or unknown, which I and my successors, transferees, assigns and related entities now own or hold, or have at any time heretofore owned or held, now or hereafter acquired, which are related in any way, directly or indirectly, to StandWithUs acts and/or omissions arising out of or relating to my situation or my contact with StandWithUs through its Website.

Any and all controversies, claims or disputes against StandWithUs arising out of or related to these Terms, this Waiver, or the interpretation, performance or breach thereof shall be resolved by final and binding arbitration, using the Commercial Arbitration Rules of the American Arbitration Association. Any such arbitration will take place in Los Angeles, California, before a neutral arbitrator who is a member of the mandatory bar of California and is selected by both parties.
